    Second Shooter/Assistant Agreement

    Agreement


    I accept to all the terms listed below, and accepting this assignment as an Independent Contractor. By writing by name in the section below, I am digitally signing this form and agreeing to all the terms.

    This agreement is between Sara Cormier of Sara Elizabeth Photography, referred to as First Shooter, and an independent contractor whose name and address appears above, referred to as Second Shooter.

    1. Assignment: The contractor agrees to work as a second shooter, on a per wedding basis. 

    2. Independent Contractor: The Second Shooter and the First Shooter hereby specifically agree that the Second Shooter is performing the services as an independent contractor and is not an employee of the First Shooter. Nothing in this agreement shall be construed as creating an employer-employee relationship, as a guarantee of future employment or engagement, or as a limitation upon the First Shooter’s sole discretion to terminate this agreement at any time without cause. The Second Shooter further agrees to be responsible for all of contractor’s federal and state taxes, withholding, Social Security, insurance and all other benefits. The Second Shooter shall have no claim against Sara Elizabeth Photography hereunder or otherwise for vacation pay, sick leave, retirement benefits, social security, worker’s compensation, health or disability benefits, unemployment insurance benefits, or employee benefits of any kind. 

    ​3. Cards: The Second Shooter agrees to hand over all memory cards before leaving the event. The First Shooter will download the cards the next day and mail them back to the Second Shooter once the final wedding gallery has been delivered. 

    4. Copyright: The Second Shooter agrees the images are owned by the First Shooter. The Second Shooter agrees not to sell any image taken during a contracted event from the First Shooter to any person, company, group, advertising agency or otherwise without the First Shooter’s express written permission. 

    5. Usage: The First Shooter grants the Second Shooter permission to use the images taken during a contracted event for the contractor’s social media, portfolio, website or blog. All images used on the web must give full credit. It should include a “photographed for Sara Elizabeth Photography” statement. The Second Shooter must wait to use the images online until after the First Shooter has delivered the final gallery. The Second Shooter must not tag or use last names of clients. First names are allowed. 

    6. Client Interaction: The Second Shooter may not Facebook friend the client or their wedding guests. The Second Shooter cannot connect with the client in any way for any reason.  The Second Shooter must be professional, respectful, polite, courteous, and deferential to all participants at all times. Respect and understand the First Shooter’s role as the main hired photographer. 

    7. Business Representation: The Second Shooter will be given the First Shooter’s business cards to hand out if anyone asks during the wedding. The Second Shooter is not permitted to promote his or her own business during the wedding. Second Shooter must not give out business cards, mention the his or her business name or that he or she owns a business, before, during, or after the event.  This includes networking with other vendors, only the First Shooter's business information should be given out. Second Shooter must not drink alcohol or smoke during the event. The Second Shooter is representing the First Shooter's business and is required to do so in a respectful and professional manner. Violation of any of these terms is grounds for immediate termination and revocation of contract.

    8. Confidentiality: The Second Shooter understands that all materials, price lists, contracts, financial documents, agreements and other information or documents that are given to him/her in the scope of his/her assignments are the exclusive property of the First Shooter and are privileged and confidential information. The Second Shooter agrees not to reveal this information to anyone, nor to use this information to the detriment of the First Shooter, including to circumvent or to undercut sales. The Second Shooter agrees that all materials as described above must be returned to the First Shooter at the end of this contract. 

    9. Liability: The Second Shooter warrants that he/she will perform when contracted for a photographic assignment and that he/she is liable for any loss or other financial liability suffered by the First Shooter, due to failure to perform other than a documented medical emergency or an “Act of God.”  The First Shooter is not liable for any loss or damage to the Second Shooter’s equipment under this contract. 

    10. Equipment: The Second Shooter is responsible for providing all of his/her own equipment with which to complete the assignments. This includes providing his/her own media cards to photograph with if the First Shooter does not provide them. The First Shooter requires that weddings be photographed in RAW format and that all original digital files are relinquished to the First Shooter upon completion of the contracted job. 

    11. Wedding Day Conduct: Second Shooter will dress in dark or neutral colors and will appear neat and clean. No white clothes or busy patterns will be worn. Attire is business casual or "dress like a guest". The First Shooter will give the Second Shooter an arrival time. Second Shooter must arrive 15 minutes early. The First Shooter expects the Second Shooter to reserve the entire day of the event from the arrival time, in case the First Shooter needs the Second Shooter to stay longer than expected. Second Shooter will not be late unless it is an act of God. The Second Shooter will call the First Shooter in the event of an emergency or delay.  Second Shooter must follow all instructions given by First shooter and do so in a respectful manner. 

    12. Loss of Photos and or Damage Created: If there is a loss of photos taken at a wedding, it is at the discretion of the First Shooter whether and how much the Second Shooter will receive for his or her final payment. If the Second Shooter causes damage at the event that requires replacement or punitive damages, the Second Shooter and the Second Shooter alone are responsible for his or her actions.

    13. Payment will be arranged on an individual basis for each Second Shooter. Payment will be an hourly amount depending on experience and the assignment, typically between $35 and $50 per hour. Assignments range from 6-10 hours.  Second Shooter shall be responsible for all expenses, including, but not limited to, travel expenses, toll road fees, parking fees, meals, equipment costs, rental fees and repair costs. 

    14. No Guarantee of Work This Agreement is not a guarantee of work by First Shooter to Second Shooter.  This Agreement shall only state the Services to be provided by Second Shooter as requested by First Shooter.



    • This agreement constitutes the full agreement of the parties. Any modification of this agreement must be in writing and signed by both parties. If any provision of this agreement is declared invalid, then the remainder of the agreement will remain in force and in tact. I have read and agree to the terms of this contract.
